Terms and conditions of use

All orders that you place on the Website will be subject to acceptance in accordance with these terms and conditions.

The following is required to create a contract between you and us:


Please follow the simple onscreen instructions taking you through the process of placing an order on the website. You place the order for your products by pressing " Checkout" on the "Review Your Order page", and in doing so you offer to buy the goods at the prices indicated as well as any applicable delivery charges.


An order acknowledgement email will be sent to you detailing the products you have ordered. Please note that this email is merely an acknowledgement of your order and not an acceptance or confirmation of your order by SimonJohnDesigns.


The acceptance of your order and the completion of the contract between you and us will take place on payment of the products unless we have notified you that we do not accept your order or you have cancelled it. If you have ordered custom or bespoke products the acceptance of your order and the completion of the contract between you and us will occur when you receive a confirmatory letter from us unless we have notified you that we do not accept your order or you have cancelled it. Once we have accepted your order and it is paid for in full it becomes binding, subject to your rights of cancellation. Non-acceptance of an order by us will occur if the ordered product/s is out of stock or unavailable, if we identify a pricing or product description error or are unable to obtain authorisation for your payment.


We reserve the right to withdraw any products from this website at any time or remove or edit any information on our website. We will not be liable to you or any third party by reason of our withdrawing any product from our website whether or not that product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.


To be eligible to purchase products on this website you must be over 18 years of age, register by providing your real name, phone number, email address, payment details and other requested information also provide a valid delivery address and a valid credit or debit card issued by a bank acceptable to us.


Please note that PO box numbers, hotels and temporary addresses are not permitted.



Standard Wallpaper, Superwide Wallpaper and Vinyl.



Weights, dimensions and descriptions of goods given by us to you for any purpose are stated in good faith but are approximate only and will not form part of any contract with you nor bind us in any way. We reserve the right to withdraw, or amend, the specification of any goods and pattern without further notice to you.

Wallpapers ordered in excess cannot be return due to the custom fitting method used within the ordering process

Any shortfalls in requirements are the sole responsibility of you the buyer.


Paper Hanging


Please consult our website for hanging instructions and a visual reference prior to installation. Any papers that are hung in the wrong direction or repeat are the responsibility of the buyer. All surfaces must be properly prepared, if in doubt consult a competent / qualified decorator. We accept no responsibility for papers that are not hung properly.

Precise colour matching cannot be guaranteed between different batches. If re ordering to match an existing product you must include the batch number.

Custom wallpapers will be matched only if we are supplied with an original piece and whilst we will endeavor to produce a good match we cannot guarantee a perfect match.

The information given in our specifications or technical / hanging advice,  whether verbal or written is for guidance and is given in good faith but without warranty, as site conditions and levels of skill in application are beyond our control. We can accept no liability for the performance of the products arising out of such use, beyond the value of the goods supplied by us.



Cancellations and Returns



When returning clothing Products, please return them to us by one of the following methods together with proof of purchase (a receipt or dispatch note).


We ask that you take reasonable care when handling the products and return the products unopened, unused and in their original packaging, where possible.


Once Products have been delivered, you may return them within 28 days of receipt of delivery by one of the methods below:-


By Courier:


You may return any products to us by courier at your own cost and risk.


Please note that we are not liable for any loss or damage to any returned products in transit and as such, we recommend that you return any products through a recorded delivery service.


When returning products, please package the products properly and securely together with the dispatch note to ensure that the products are not damaged during transit.


If returned products are lost or damaged in transit, we reserve the right to charge you, or refund any amounts attributable to you through loss or damage.

Wallpaper Cancellations and Returns



The happiness of our customers is extremely important to us. Each and every SIMONJOHNDESIGNS order is custom printed for the individual who orders it, which means that we cannot re-stock and re-sell material that is returned to us. If you receive a flawed or damaged order, we are always willing to replace or refund it. If you wish to return an order for some other reason, please know that we are happy to work with you on a case by case basis to make sure you're not stuck with wallpaper that you cannot use and don't absolutely love.


Custom wallpaper is returnable when deem to be faulty, please note quality inspection takes place before postage to the consumer.


WallArt Returns

WallArt returns are acceppted when the WallArt has not been separated from the transfer paper or backing paper. Once the transfer paper or backing paper has been remove returns will not be accepted. We encourage you the customer to measure your area of application carefully before ordering. 

If the WallArt is deemed to be faulty then returns will also be accepted in the form of a refund or replacement product if so desired.

Wrong full application is not a vaild reason for returns unless a fault with the product has resulted in the application being compromised 

When returning the product make sure it is returned in the orginal package which has been provided or a suitable comparable packaging. Return postage is the customers responsibility 



Product Use



All of our products are designed for interior use unless otherwise stated. It is you, the buyer’s responsibility to ensure that the product is fit for purpose for the end use. 



Product Descriptions, Colours and Characteristics



Every effort is made to ensure that the Products we supply correspond as closely as possible to the samples displayed online, but there may be variations as natural materials have unique characteristics. No responsibility can be accepted for these variations, which all add to the unique features of our products including but not limited to the following:


On fabric, WallArt and wallpaper the shade may vary slightly from one printing batch to another.


We reserve the right to make any change to the specifications of our products where necessary.



Intellectual Property



You recognise and agree that all copyright, database rights, trademarks and all other intellectual property rights in all material and/or content of this website is owned by SimonJohnDesigns or our licensors and shall remain at all times vested in us or our licensors as expressly authorized by us or our licensors.



Data Protection and Privacy



We will respect the privacy of your personal data, and will comply with all relevant and current data protection legislation. We will not disclose your personal data to anyone, unless required to do so by a court of competent jurisdiction.


If you wish to update or delete your personal information that has been specifically left on our mailing list. Please contact us.

To proceed with your order, we have to process and store your data, and provide your data to third parties who are directly involved with your order, e.g. our couriers. By placing an order with us, you agree to your data being processed by SimonJohnDesigns. We will not pass on your data to anyone outside or organization.


Printing

Any order placed by you constitutes an offer to purchase the Products from us. All such offers received from you are subject to acceptance by us and we reserve the right to refuse any order placed by you at any time prior to acceptance, without providing an explanation. Orders are placed via our internet platform www.simonjohndesigns.com

 

You shall be responsible for ensuring the accuracy of the details provided by you during the order process and we will not accept an order unless all details requested from you have been entered correctly.

 

We will send a confirmation that we have received your order automatically by email. Orders received after 18:00 hours will be deemed as having been received the following working day

 

You agree that if we contact you to acknowledge receipt of your order such communication shall not amount to our acceptance of your offer to purchase the Products ordered by you from the Website.

 

You will be subject to the version of our policies and Conditions in force at the time that you order the Products from us, unless:

  • Any change to those policies or these Conditions is required to be made by law or governmental authority

 

 

For any orders placed with us, we presume our customer to be the owner of any necessary copyrights relating to documents, images, logos, fonts, which are protected under the intellectual property laws.

 

Artwork files supplied to us must be in strict accordance with our Technical Specifications.

The customer must accept unreservedly the technical constraints associated with this type of printing:

  • Trimming tolerances of 1mm

  • Colour variations Where Customer has not submitted Artwork in CMYK mode in accordance with the Format Requirements, SIMONJOHNDESIGNS shall be entitled to convert the Artwork to ensure it complies with the Format Requirements. In these circumstances, the liability for any resulting colour deviations lies solely with the Customer. By transmitting the Artwork in any other mode than the specified CMYK mode, the Customer acknowledges and agrees that the conversion is carried out at Customer’s own risk.

  • When reprinting jobs even from exactly the same files, we can’t guarantee that the colour rendering will be identical to the previous printed item.

 

 We will not be responsible when defects are present on the customers file in relation to trapping, fonts, image conversion, colour calibration etc

 

The customer must be aware that the representation of colour that they see on screen is not a true and accurate representation of what the final printed product will look like. Additionally desk top printers or copiers will not present an accurate representation of how the final product will look when professionally printed.

 

We may make modifications to the supplied file where it does not conform to our technical requirements (bleed, pantone colour conversion, RGB image conversion, etc). Similarly we reserve the right to refuse any order that does not conform to our DTP guide

 

We will never be liable in the event that our technical requirements aren’t adhered to (as outlined in the DTP guide).

 

We recommend that to mitigate against these risks our clients request a Fogra certified proof digital proof. This will give a fair representation of how the final product will look in advance of full production and will highlight any of the potential issues raised above.

 

We will not undertake authors corrections on any supplied files and so in the instance where this is required we will ask the customer to make the amendments themselves and then re-supply the files to us for production.

 


Design

Products that require design will be completed once payment is recieved. This does not include an unlimited amount of redesigns and will require a further design payment after two redesigns. Unsatisfied design will result in a refund for the product but the design fee will remain. 



Amendments to these Terms & Conditions



We reserve the right to amend these terms and conditions at any time. Any such amendments will take effect when posted on the Website and it is your responsibility to read the terms and conditions on each occasion you use the Website and your continued use of the Website shall signify your acceptance to be bound by the latest terms and conditions.



Order Placement



1.      Placing an Order


-  Find the product(s) you want 

-  Add the products to your shopping cart

-  Proceed to checkout

-  Select delivery and billing options

-  Ensure your items, sizes and address are correct

-  Submit your order

-  An order confirmation will be sent to your email address

Remember to check your basket and delivery information to ensure everything is correct before submitting your order as we may not be able to amend it! 

When you submit an order, we will send you an email acknowledging receipt of your order. This does not mean that we have accepted your order. Only when your order has been shipped the order has been accepted. You will also receive a shipping confirmation email once this has taken place.

If we are unable to supply you with a product, we will inform you of this in email and offer you an alternative if applicable.


1.1      Our Right to Reject or Cancel Your Order


Fulfillment of all orders on the Website is subject to availability. We explicitly reserve the right not to accept your order for any of the following reasons:

-  The product is not available / in stock

-  Your billing information is not correct or not verifiable

-  Your order is flagged up by our security systems as an unusual order or an order susceptible to fraud

-  We have reason to believe that you are a selling our products with no prior agreement to do so

-  We could not deliver to the address provided by you

-  Due to an Event Outside Our Control 

-  In the event of misspelling, pricing or other errors or mistakes in the website information

 

1.2      Data Check


We may run some checks on your details before we ship your order. These checks may include verifying your address and checking for fraud. There are automated processes in place to filter out any suspicious orders which may be fraudulent. All fraudulent orders will be investigated and prosecuted if necessary.



Prices/Currency



 The product prices displayed on the Website are inclusive of Value-Added Tax (VAT). Shipping rates are applied per order. The exact shipping rates depend on the country where your order is being delivered to. For details on shipping rates, please refer to Delivery section).

Currency can be changed using the currency button at the top of the website, although the price will be charged in GBP (Great British Pounds)

The total price specified in the final check out screen includes tax and shipping costs. This price will be recorded in the Order Confirmation, which we recommend you print or download for future reference. If paying by credit card, the total amount for your entire order will be reflected on your statement in your local currency.

If your local currency is different from the currency in which the prices are quoted, your bank will apply the exchange rate applicable per the date of purchase. Your bank may apply a different exchange rate, which is beyond our control.


2.1      Price Changes


The prices of the products will be as displayed on the Website. Prices may change from time to time, but these changes will not affect any order that has already been placed and the order confirmation email sent.



Intellectual Property Rights



SimonJohnDesigns owns all intellectual property rights on the website and  the patterns  published on it. These works are protected by copyright laws.

At SimonJohnDesigns, we take protecting your privacy very seriously, and have a strict privacy policy with a number of measures that ensure all your information is securely protected.


We will occasionally require some basic details from you in order to help progress with any enquiries and orders you make with us. This includes things like name, email address and telephone number.


Any information we gather is for use strictly to help us carry out our work on your behalf and deliver the service and products you require from us.


In no circumstances will your information or personal data ever be sold or given to any other company or person outside of our business.
